These Terms of Use outline the conditions for participating in the Amby Rewards Program (the "program"). By participating in the program, you agree to these terms and confirm that you understand and accept the associated risks and requirements.

2. Health and Safety

Amby is not responsible for any injuries or health issues that may occur as a result of participating in activities related to earning points. Participants are advised encouraged to exercise within their limits and seek medical advice from medical professionals as needed if you are feeling unwell.

3. Eligibility for Participation

To participate in the Amby, individuals must have an active +852 Hong Kong local mobile phone number registered with WhatsApp. This requirement ensures that participants can effectively engage with our WhatsApp-based rewards system and receive timely updates and notifications pertinent to their activities and rewards within the Hong Kong Special Administrative Region (Hong Kong S.A.R.). Participants without a valid +852 mobile number may not be able to receive full benefits or participate in the program.

4. Participation Discretion

Amby reserves the right to ban or bar participants at its sole discretion without explanation.

5. Account Creation and Data Management

By initiating use of the Amby WhatsApp bot, you authorize the automatic creation of a user account where your WhatsApp number will be registered. All submitted data during your interaction with Amby, including but not limited to activity submissions and points accrual, will be associated with this account. This account will remain active to maintain your historical data and facilitate ongoing interactions with our services. The account and its associated data will be retained as part of your participation record even after discontinuation of active use, unless an explicit request for deletion is submitted according to our data deletion protocols outlined in our Privacy Policy.

6. Medical Advice

Amby is not a medical organization and does not provide medical advice, diagnosis, or treatment. All activities are performed at your own risk. Participants are encouraged to seek medical advice from medical professionals prior to engaging in and during engagement in Amby activities.

7. System Abuse

Participants caught engaging in system abuse, including but not limited to hacking, cheating, and falsifying records, will be subject to immediate disqualification and banning from the program at our discretion.

8. Service Availability

We do not guarantee uninterrupted service availability or access to the program, which may depend on external factors such as network coverage or platform availability.

9. Modification of Activities

Amby reserves the right to modify, add, or remove the types of fitness, nutrition, and wellness activities eligible for earning points within the Amby Rewards Program at any time, with or without prior notice. These changes may be made to improve the effectiveness of the program, adapt to changing health guidelines, or better align with user engagement and feedback.

By participating in the Amby Rewards Program, you acknowledge and agree that the list and nature of activities that qualify for earning points may change and that these modifications may occur at our sole discretion. We encourage participants to regularly review the updated list of activities through our app or via WhatsApp to stay informed about what qualifies for point accumulation.

10. Adjustments to the Points System

Amby reserves the right to modify the points system and the algorithms that govern it at any time and without prior notice. Our proprietary AI algorithms are designed to ensure fairness and provide meaningful rewards to participants based on their activities. The points awarded for similar activities may vary from one instance to another based on numerous factors determined by our algorithms. For example, while you might receive 100 points for completing a specific activity today, the points awarded for the same activity tomorrow may differ. This flexibility in our points system helps adapt to varying participant behavior and ensures that rewards are distributed in a manner that motivates sustained healthy habits. By participating in the Amby Rewards Program, you acknowledge and agree that the points system is subject to such adjustments and that the calculation of points may not always be transparent or predictable.

11. Point Expiration and Redemption

By participating in the Amby Rewards Program, you acknowledge and agree to the following terms regarding the expiration of points:

1. Points are accumulated in batches corresponding to the threshold for Tier 1 rewards, which is 16,000 points.
2. Each batch of 16,000 points will have an expiration period of 3 months (90 days) from the date the batch is completed.
3. If points are not redeemed within the 3-month expiration period, the entire block of 16,000 points will expire.
4. The expiration of points will occur at midnight (12:00 AM) Hong Kong local time on the 91st day following the completion of the batch.
5. It is the participant's responsibility to track their points and ensure they are redeemed before the expiration date.

12. Program Cessation

Amby may cease operations at any time. We will strive to give as much notice as possible if we decide to cease operations, but this is not guaranteed.

13. Reward Availability

Rewards are subject to availability and may be modified or removed at any time without notice.

14. Service Level Agreement

Our commitment to process rewards within 72 hours is a target, not a guarantee. Delays may occur, and we are not liable for any direct or indirect losses caused by such delays.

15. Changes to Terms

Amby reserves the right to change these terms at any time without prior notice. Participants are responsible for staying informed about any changes to the Terms by continuously returning to these Terms as frequently as possible.

17. Privacy and Data Use

By participating in the Amby rewards program, you agree to our collection, use, and sharing of your personal information as outlined in our Privacy Policy. We encourage you to read the Privacy Policy carefully to understand our practices regarding your personal information and how we will treat it.

18. Prohibited Use

Participants agree not to use the Amby Rewards Program, including the associated website, mobile application, and WhatsApp bot, for any unlawful or prohibited activities. This includes, but is not limited to, engaging in or promoting activities that are criminal in nature, involve the sale or distribution of illegal substances, or any other conduct that violates the laws of Hong Kong S.A.R. or applicable international laws.

19. Liability for Misuse

Amby is not responsible for and disclaims all liability related to the illicit use of the Amby Rewards Program by any participant. Participants are solely responsible for ensuring that their use of the program complies with all laws and regulations. Any illegal use of the program may result in immediate termination of participation and potential legal action against the offending participant.

Participants are urged to respect all applicable laws and use the Amby Rewards Program only for lawful purposes. Failure to comply with this directive may result in the suspension or termination of access to the program and its features.

20. Ownership and Operation

The Amby Rewards Program, including associated services such as the Ambywell.com website, the Amby mobile app, and the WhatsApp bot, are products and services provided by Playmaker Ventures Limited, a company incorporated and operating under the laws of the Hong Kong Special Administrative Region (Hong Kong S.A.R.). This program is managed and maintained by Playmaker Ventures Limited, which reserves all rights associated with or arising from its operation.

21. Intellectual Property Rights

All content, trademarks, logos, and service marks displayed on or through the Amby Rewards Program including, but not limited to, the name "Amby", "Ambywell.com", and any associated graphics, logos, designs, and icons are registered or unregistered trademarks protected by international copyright and intellectual property laws and are owned by Playmaker Ventures Limited. Unauthorized use, reproduction, modification, or dissemination of these trademarks and any content provided as part of the Amby Rewards Program is strictly prohibited and may be pursued legally.

22. Marketing Communications Consent

By participating in the Amby Rewards Program, you consent to receiving occasional communications from or on behalf of our current or future sponsors or partners. These communications may include marketing messages and promotional content.

23. Merchant Affiliation Disclaimer

Amby is not affiliated, associated, authorized, endorsed by, or in any way officially connected with the merchants whose gift cards are offered as rewards through the Amby Rewards Program. All merchant names, logos, and brands are the property of their respective owners. The use of these names, logos, and brands does not imply endorsement. The gift cards provided as rewards are purchased by Amby and offered to participants of the Amby Rewards Program without any partnership or direct association with the merchants. Amby explicitly disclaims any sponsorship, endorsement, or affiliation with any merchant. Participants acknowledge that any merchant-related queries or issues associated with the use of gift cards should be directed to the respective merchant and not to Amby.

Participants and users are prohibited from using the name of the Amby Rewards Program or its related properties to defame, tarnish, or misrepresent Playmaker Ventures Limited and its services. Additionally, no participant or user may engage in activities that would directly compete with or replicate the operations and services of the Amby Rewards Program without express written consent from Playmaker Ventures Limited.

24. Governing Law

These terms are governed by the laws of Hong Kong S.A.R.

25. Language

In the event of a discrepancy between the English and Cantonese versions of these Terms, the English version shall prevail.
